We were paying for the machines to have the proper licenses, they were just on freeplay and not earning any money other than what the locations were paying us to lease them, as well as what all our other machines in there were making (Megatouches and Golden Tee's).Īnyways, the story I was told by my boss was that some of the people that were getting sued for using Napster had some great lawyers, and the lawyers were going to court and arguing that a song has no inhierant (spelling?) value because you could play them for free in jukeboxes that were set on freeplay. Basically restauraunts were leasing them to allow their customers to play for free, these were bubbler Wurlitzer and Rock-Ola's. I worked for an op a few years ago, and we had jukes out in locations on Freeplay. Their only complaint could be that it's playing licensed music in the bar, therefore it's a jukebox, but like we were talking about above, all kinds of games play licensed music so you could say the same thing about any of them.
